Arbitration
and Dispute Resolution
We offer to resolve disputes by arbitration. Arbitration
provides a quick, confidential and inexpensive alternative
to full court litigation.
CATEGORIES
We will provide dispute resolution in the following
categories...
- No appearance
Each party presents his or her case in writing. The
arbitrator decides the matter on such written statements.
- Inquisitorial hearings
Written statements and supporting documents are produced.
No legal representation, but argument and necessary
evidence.
- Simple accusatorial
hearings
There will be simplified pleadings, discovery of documents
and legal representation allowed, with or without
evidence.
- Commercial hearings
Full-scale commercial hearings following the proceedings
and rules of the Association of Arbitrators, or a
shortened form if this be agreed.
HOW TO START
Arbitration can only be held if all parties to the dispute
genuinely wish to resolve it and wish to maintain a future
business relationship
Once appointed our arbitrator will call and chair a preliminary
meeting to decide the issues, time limits and the format
of the arbitration agreement.
Our arbitrators have a hands on approach to
the procedure. They ensure that time limits are kept and
that the arbitration is speedily concluded.
VENUE
We will usually arrange for the arbitration to be held
in one of our conference/board rooms. The arbitrator's
time is charged but there is no charge for the use of
the venue. We can arrange for the proceedings to be recorded
and transcribed in those rare cases where this is necessary.
